New York Arbitration Week

November 15-19, 2021

David D. Caron Praelium Debate

Program Host: Columbia Law School, King’s College London and Three Crowns
When: Tuesday, November 16, 2021
Where: The Harmonie Club (4 East 60th Street)
5:30
p.m. – 7:30 p.m.

Topics for Debate:

1.   Whether, after a claim had been commenced by a dual national under a BIT, the contracting states could agree to deny benefits to nationals of a third State (of which the Claimant was one).

2.   Whether measures taken by a State, purportedly in pursuit of addressing climate change or the COVID-19 pandemic, constituted a justifiable exercise of a State’s police powers which can be taken into account in an FET claim in the context of a Treaty which did not specifically address welfare objectives.

A request for CLE credit is pending for NY.  To receive credit, please record the codes that will be displayed on the screen during the program and submit the CLE form (linked below) and evaluation. You must provide your state bar/ARDC number in order to receive credit.
