Topics for Debate:

1.   Whether, after a claim had been commenced by a dual national under a BIT, the contracting states could agree to deny benefits to nationals of a third State (of which the Claimant was one).

2.   Whether measures taken by a State, purportedly in pursuit of addressing climate change or the COVID-19 pandemic, constituted a justifiable exercise of a State’s police powers which can be taken into account in an FET claim in the context of a Treaty which did not specifically address welfare objectives.
