Diversity Challenge: Reinventing the Landscape for Young IA Practitioners.

Join the New York International Arbitration Center (NYIAC) and various young arbitration groups — including American Arbitration Association-International Centre for Dispute Resolution’s Young & International (AAA-ICDR’s Y&I), the Young ArbitralWomen Professionals (YAWP), the International Institute for Conflict Prevention and Resolution’s Young ADR (CPR’s Y-ADR), Chartered Institute of Arbitrators Young Members Group (CIArb YMG), the International Chamber of Commerce Court of Arbitration’s Young Arbitrators Forum (ICC’s YAF), and the Silicon Valley Arbitration and Mediation Center’s Young Professionals (SVAMC YP) with the ADR Inclusion Network — for a panel discussion with break-out sessions on the state of diversity in international arbitration. Delegates will help to define diversity in a changing world and strategize tips and tools to move the needle measurably forward.

JAMS Lunch Program – M&A and Complex Financial Disputes in Arbitration

A panel of experienced global arbitration advocates and senior in-house counsel moderated by Robert B. Davidson FCIArb, JAMS arbitrator and mediator, will examine the kinds of M&A and financial transaction disputes commonly seen in arbitration. The panel will discuss differences in approach between domestic and international M&A cases, and delve into the considerations corporate users weigh when opting for arbitration. Panelists also will turn their attention to clauses limiting disclosure and/or specific categories of damages, and to current legal developments that affect the arbitration of these claims. Lunch will be provided.

Restatement of the Law Third, The U.S. Law of International Commercial and Investor-State Arbitration Program and Reception

George A. Bermann, FCIArb, Professor, Columbia Law School and Reporter for the Restatement, will lead this program in which Associate Reporters and Advisers will discuss key issues that were the focus of debate or controversy during the decade-long development of the Restatement.  The speakers will address matters of practical concern to practitioners and will explain how issues were resolved to serve the interests of clarity, predictability, and, in some instances, the promotion of best practices in commercial and investment arbitration. Dispute Resolution Program (AAA-ICDR) Program and Reception

In-house counsel from the life sciences, technology and construction industries discuss best practices and the unique aspects of conducting an international arbitration in these fields. This panel will provide perspectives on clause drafting considerations, the impact of governing law including New York Law, mediation, selecting arbitrators, coordinating with outside counsel, key milestones, document production, and maximizing the services provided by the administering institution. ICC International Court of Arbitration Breakfast Program

Since entering into force in 2012, ICC emergency arbitrator proceedings have become an important tool in the dispute resolution process. Despite the increasing frequency with which these proceedings are utilized, many practitioners have yet to have the benefit of first-hand experience. 

The recently released ICC Commission Report on Emergency Arbitrator Proceedings examines the first 80 EA cases under the ICC Rules, identifying trends and offering guidance based on the collective experience with these proceedings thus far. Join us for a discussion over breakfast to learn about the key takeaways from the report and hear from experienced practitioners as they share practical advice and expert insight on how to effectively manage emergency arbitrator proceedings as both counsel and arbitrator under the ICC Rules.
